Moratorium on Commercial Lease Evictions

The State Government has announced an extension of the moratorium on evictions for commercial leaseholders to the end of 2020.

A copy of the press release is attached.

The press release refers to the fact that  “it is not too late for businesses to come forward and receive assistance under the Code until December 31”.

It is not clear from the press release whether the intention is that the extension only apply to the moratorium on evictions or whether the “response period” as defined in the Retail Shop Lease and Other Commercial Leases (COVID-19 Emergency Response) Regulation 2020 (“the Regulation”) will be extended.

The Regulation currently defines “response period” as the period commencing on 29 March 2020 and ending at the end of 30 September 2020.

Unfortunately, the effect of the State Government’s announcement remains unclear. Hopefully, further information regarding the extension of the moratorium on evictions will be provided before the conclusion of the response period.
